2. AI Services — Use of Data

Our AI-powered services (including media kit generation, press release drafting, geo-intelligence tools, and related features) require you to submit content such as text, prompts, company information, and media files. By submitting content to our AI services, you explicitly consent to the following:

• Your submitted content will be processed by VIVI Media's AI systems to generate the requested output.
• Anonymised or aggregated versions of submitted content may be used to improve AI model performance and service quality.
• VIVI Media may analyse usage patterns and service interactions to enhance the quality and relevance of AI outputs.
• You grant VIVI Media a non-exclusive, royalty-free licence to process your submitted content solely for the purpose of delivering the Services.

You retain full ownership of the content you submit. VIVI Media does not claim intellectual property rights over your inputs. You are responsible for ensuring that any content you submit does not infringe third-party rights and complies with applicable laws.

3. AI-Generated Outputs — Disclaimer

AI-generated content is provided for informational, creative, and drafting purposes only. VIVI Media does not guarantee the accuracy, completeness, legality, or fitness for purpose of any AI-generated output. You are solely responsible for reviewing, editing, and verifying all AI-generated content before publication, distribution, or use in any professional or commercial context. VIVI Media accepts no liability for decisions made based on AI-generated outputs.

4. Newsletter Subscription

By subscribing to Vivi's Newsletter, you agree to receive periodic email communications from VIVI Media containing insights, articles, and updates on AI, media, marketing, and related topics. You confirm that:

• You are providing your genuine email address and consent to receive these communications.
• Your email address and subscription preferences will be shared with Beehiiv, our newsletter platform, for the purpose of delivering the newsletter.
• You can unsubscribe at any time by clicking the unsubscribe link in any email or by contacting [email protected].
• Unsubscribing will remove you from the mailing list within 10 business days.

5. Consulting and Professional Services

Consulting, speaking, and media services provided by VIVI Media are subject to separate engagement agreements. Any advice, strategy, or recommendations provided through consulting services are based on information available at the time of engagement. VIVI Media does not guarantee specific business outcomes or results from consulting engagements.

6. Payments and Refunds

Payments for AI services and other paid features are processed securely through Stripe. All prices are displayed in USD unless otherwise stated. Payments are non-refundable once an AI service has been delivered, except where required by applicable consumer protection law. If you experience a technical issue that prevents delivery of a paid service, please contact us within 7 days at [email protected].

7. Acceptable Use

You agree not to use our Services to:

• Submit content that is unlawful, defamatory, harassing, fraudulent, or infringes third-party intellectual property rights.
• Attempt to reverse-engineer, scrape, or extract data from our AI systems.
• Generate content intended to deceive, manipulate, or harm others.
• Violate any applicable laws or regulations.

VIVI Media reserves the right to suspend or terminate access to Services for users who violate these Terms.

8. Intellectual Property

All content on the VIVI Media website — including text, graphics, logos, and software — is the property of VIVI Media or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our website content without prior written permission.

9. Limitation of Liability

To the fullest extent permitted by law, VIVI Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to VIVI Media in the 12 months preceding the claim.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
